All prospective homes for our thoroughbreds are subject to approval. You must first make an appointment to meet us, and your prospective horse, by contacting us at sctbrescue@live.com. If the initial meeting with us and your prospective horse goes well, you can fill out our rehoming application form (below) which may be downloaded and printed, or obtained from us directly. Once we have received your completed application form, approvals may take as long as two to four weeks to obtain. No approval is possible without an "on-site" check of the potential home's facility, and our receipt of three glowing references. Our rehoming application, and a sample rehoming agreement, follow.

1.CONSIDERATION: In consideration for the stated fee of___________, payable upon execution of this agreement, Southern California Thoroughbred Rescue grants to Custodian the care, custody and control of the horse ____________________ Jockey Club Reg.#______________, for the purpose of providing a safe, healthy and loving environment for the horse, under the following terms and conditions.
2. RIGHT OF TERMINATION: Custodian understands that the subject horse remains the property of Southern California Thoroughbred Rescue for it’s lifetime. Custodian understands that Southern California Thoroughbred Rescue grants care, custody and control of the above horse to Custodian only for such time as the above horse shall be maintained according to acceptable standards of horse husbandry. Custodian agrees to maintain said horse in good health, to provide adequate food, free access to water, shelter, farrier and veterinary care, at no cost to Southern California Thoroughbred Rescue. At such time as said horse is not maintained according to acceptable standards of horse husbandry, as shall be determined upon the examination of a licensed veterinarian, this agreement shall terminate and Custodian shall surrender said horse to Southern California Thoroughbred Rescue upon demand.
3. REQUIRED VETERINARY CARE AND REPORTING: Custodian agrees that, at a minimum, the following veterinary and podiatric care will be provided for the horse according to the schedule noted, at the sole expense of the Custodian. 1) Annual general veterinary examination, unless waived in writing by Southern California Thoroughbred Rescue 2) Inoculations, by April 1st of each year, including Eastern/Wester Encephalitis, Influenza, Tetanus, West Nile, Strangles and as the Custodian's veterinarian recommends 3) Worming every six to eight weeks 4) Hoof care every six to eight weeks 5) Annual teeth floating and any other necessary dental care. Custodian agrees to forward to Southern California Thoroughbred Rescue written documentation of his/her veterinarian's visits and findings in administering the above minimal care, and for any other reason including at the request of Southern California Thoroughbred Rescue, that is signed and produced by Custodian's licensed veterinarian. The documentation must be received by Southern California Thoroughbred Rescue within one week following each veterinarian visit.

4. RIGHT OF INSPECTION: Custodian agrees that any authorized representative of Southern California Thoroughbred Rescue shall have the right to inspect the subject horse, and the facilities where said horse is maintained, at any time.
5. COST OF RECOVERY: In the event that Southern California Thoroughbred Rescue shall void this agreement for reason of insufficient standard of care to the above horse, Custodian shall be responsible for all costs of recovery, including transportation and legal fees.
6. DISCLOSURE: Southern California Thoroughbred Rescue agrees to disclose any known injuries, blemishes, unsoundness, or other pre-existing conditions. Custodian understands that many conditions of the horse are not obvious, and that Southern California Thoroughbred Rescue cannot know all the details of a horse’s history. Custodian acknowledges that he or she has sole responsibility for determining if the horse is fit for use. Custodian acknowledges that he or she has been advised by Southern California Thoroughbred Rescue to engage the services of a licensed veterinarian to evaluate said horse for intended use. Custodian agrees to accept the above horse as is, subject to the return provisions of Paragraph 7.
7. RIGHT OF RETURN: In the sole discretion of the Custodian, the above horse may be returned to Southern California Thoroughbred Rescue at any time, should the horse become unwanted for any reason. Custodian shall be responsible for all costs of return.
8. WARRANTIES: Southern California Thoroughbred Rescue warrants that it has good and clear title to the horse _______________________, free from any liens. Custodian understands and agrees that the horse is accepted from Southern California Thoroughbred Rescue without conditions or warranties of any kind except as otherwise stated herein, including health, soundness, temperament, or fitness for a particular purpose.
9. TRANSFERS, ASSIGNMENTS, SLAUGHTER: Custodian shall not transfer (sell, lend, lease, give away, donate) or assign use of the above horse to any other party. Custodian shall not slaughter the horse. Custodian understands that if any of these conditions of the agreement is violated, Custodian will be subject to legal action.
10. LIMITATION OF USE: The horse is transferred to Custodian solely for the use as agreed to by Southern California Thoroughbred Rescue. Custodian understands that the horse cannot be used for racing of any kind. Entry into any race, or the publication of any recorded work by the horse __________________, will automatically void this agreement and Southern California Thoroughbred Rescue shall take possession of the horse.
11. BREEDING RIGHTS: The horse may not be used for breeding purposes.
12. CHANGE OF ADDRESS: Custodian agrees to notify, and must receive written approval from, Southern California Thoroughbred Rescue 30 days prior to any change in location of horse. Adopter will otherwise maintain subject horse at the following address: Name, address and telephone number of the boarding facility where horse will reside: ______________________________________________________________________
13. DEATH OF HORSE: Custodian agrees that in the event of the horse’s death, Southern California Thoroughbred Rescue will be notified within twenty-four hours of (a) the horse’s death, (b) the cause thereof and, (c) the circumstances surrounding the death. Euthanasia, when necessary, may only be performed by a licensed veterinarian in a humane manner.
14. DEATH OF CUSTODIAN: In the event of Custodian’s death, the horse will be released to Southern California Thoroughbred Rescue within 10 days.
15. FREEDOM FROM LIENS: Custodian agrees to keep said horse free from all liens, encumbrances, charges and claims, and to hold Southern California Thoroughbred Rescue harmless thereof.
16. INDEMNIFICATION: Custodian agrees to indemnify and hold Southern California Thoroughbred Rescue, it’s officers, directors, employees, foster care providers, and volunteers, and any former owners of the horse, harmless from and against any and all claims, actions, damages, liability, and expense in connection with the loss of life, personal injury, damage to property, or financial losses arising out of the use or care of the subject horse.
17. VALIDITY
All Parties to this Agreement must be at least 18 years of age.
